EU employment law shapes German rules on working conditions, equality, transfers and employee representation. The route from a European rule to a particular claim needs careful analysis.
What we help you decide
European employment law and cross-border remedies. We assess the relevant documents, explain the available routes and agree the scope of advice before taking further steps.
Which legal instrument applies?
Regulations, directives, Treaty rights and European court decisions do not operate in identical ways. Identify the instrument, its scope, commencement provisions and any German implementing law. The expiry of a directive’s implementation deadline does not automatically turn every provision into a claim against a private employer.
Recurring workplace issues
EU questions arise in equal pay, working time, annual leave, fixed-term and part-time treatment, transfers, collective redundancies, postings and information or consultation. Cross-border contracts also require an applicable-law and jurisdiction analysis.
Procedural route
A German court may refer a question of EU-law interpretation to the Court of Justice through the preliminary-ruling procedure. This is different from an ordinary appeal. European human-rights proceedings have a separate legal basis and admissibility requirements.
Practical example
A group assumes its global pay policy is lawful because it is uniform across countries. We test the German implementation and the relevant European equality principles against the actual comparison groups and remuneration criteria.
