Pregnant women and nursing mothers have the right to benefit from the so-called in German “Mutterschutz”, i.e. maternity leave. If the situation is not communicated in reasonable time however, the normal termination protection will apply. Upon receipt of the dismissal notice, they have two weeks to inform the employer of their pregnancy.

The following activities are forbidden for nursing mothers in a work environment:

  • Extra hours;
  • Night shifts from 8PM to 6AM;
  • Working on Sundays and holidays.

The Maternity Protection Act does not apply to directors/managers. However, the dismissal of a pregnant manager is contrary to the principles of common decency and good faith.
